Can I declare bankruptcy for a third time?

Answer

If you file bankruptcy again, you will be in bankruptcy for a minimum period of 36 months following which there would be a Court Application. The Court will then determine the terms of your discharge dependent upon your earnings, the cause of your bankruptcy and the cause of prior bankruptcies. You should consider filing a Proposal to your creditors to avoid a third banakruptcy. If you owe less than $250,000, you can file Consumer Propsal to offer a partial repayment over a long as 60 months at no interest and an amount you can afford which is usually paid monthly.
